Community Title vs Torrens Title in NSW

The main difference is simple. A conventional Torrens Title lot is generally owned and managed independently. A community title lot is also separately owned, but the owner additionally participates in a Community Association that manages shared property.

That difference affects levies, by laws, maintenance and decision making. Neither structure is automatically better. The right choice depends on the property and what is being shared.

Community Title vs Torrens Title: The Short Answer

With conventional Torrens Title, you own your parcel of land and are generally responsible for maintaining it independently. With community title, you also separately own your lot, but contribute to the ownership and management of association property through a Community Association.

What Is Torrens Title?

Torrens Title is the standard land registration system in NSW. A conventional Torrens Title property has its own registered title and defined boundaries. The owner can generally sell, transfer or mortgage it independently, subject to planning controls, easements, covenants and other registered interests.

Where there is no shared private property, there is usually no Community Association and no community levy.

What Is Community Title?

A community title lot is also separately registered under the Torrens Title system. The additional feature is association property owned and managed collectively through a Community Association.

That shared property might include roads, pathways, landscaping, environmental areas, drainage infrastructure or recreational facilities. Owners contribute to its management through levies and must comply with the Community Management Statement and by laws.

However, planning controls, easements and private covenants can still restrict what an owner can do. Torrens Title does not mean a property is free of all restrictions.

There is no reliable rule that community title makes a property worth more or less. Buyers are likely to consider the overall package, including location, quality of the development, usefulness of shared facilities, level of levies, condition of association property and restrictions within the scheme.

A well managed community can appeal to buyers who value shared facilities and coordinated maintenance and having the estate maintained to a high standard. Others may prefer the independence of a conventional lot.


Which Is Better for a Coastal Property?

Community title can make practical sense where coastal land includes private roads, landscaped entries, drainage systems, environmental areas or recreational spaces that benefit multiple owners and need ongoing management.
A conventional Torrens Title lot may be preferable where there is little shared private infrastructure and the buyer wants maximum independence. The better structure depends on what is actually shared and whether the benefits justify the levies and rules.

What Title Does Saltwater Shores Use?

Saltwater Shores at Diamond Beach is being developed as a community title subdivision. Owners have separate title to their individual lots, while association property is managed collectively through the community structure.

The title structure should not be confused with planning approval. Some nominated Saltwater Shores lots are currently approved for permanent residential accommodation, while other developable lots are approved for tourist and visitor accommodation.
